If you have registered to use our services then we may serve a notice on you by email at the email address provided to us at the point of registration.
All notices sent by email will be deemed to have been received on the day that they are sent or, if sent on a national holiday in Scotland or on a Saturday or Sunday, the next working day following the day on which the email was sent. All notices sent by post will be deemed to have been received 3 working days after the date of posting.
10. CUSTOMER FEEDBACK AND QUALITY
We try to ensure that all customer feedback is dealt with fairly and consistently, and is properly recorded. We welcome any suggestions that you make about how we may improve our service. We aim to acknowledge all customer feedback.
Phone calls directed to or from our advertisers, which include, but are not restricted to Sellers or Builders, may be recorded for training and monitoring purposes.
We may from time to time change the content of this Site or suspend or discontinue any aspect of this Site, which may include your access to it. Any amendments to these Terms will be made available.
We may revise these Terms at any time by amending this page. Please check this page from time to time to take notice of any changes we made, as they are binding on you.
If you are a business user, these Terms are the whole agreement between you and us. You acknowledge that you have not entered into this agreement in reliance on any warranty or representation made by us (unless made fraudulently).
If a court decides that any part of these Terms cannot be enforced, that particular part of these Terms will not apply, but the rest of these Terms will. A waiver by a party of a breach of any provision shall not be deemed a continuing waiver or a waiver of any subsequent breach of the same or any other provisions. You and we both agree that the courts of Scotland will have non-exclusive jurisdiction. Welcome to The Property Angel (TPA) Community. Our goal is to allow potential home movers to share the fact that they’re thinking of moving within the next 12 months and connect with other similar potential home movers. No other property portal exists in the UK to allow this to happen. Potential sellers can test the market for free and potential buyers can get a heads up on which properties are ‘coming soon’ up to 12 months ahead. This is a safe environment for property consumers, not property professionals, to interact. Property professionals looking or touting for business are not welcome and anyone reported for breaching these guidelines will be banned from the platform immediately. If you’re honest, kind and respectful to others, you’ll always be welcome here. If you choose not to be, you may not last. Please observe and respect our Safety Guidelines. They are there to protect everyone and anyone found not to be following them will be banned from the platform immediately. Please note that everyone is held to the same standard on TPA We’re asking you to be considerate, think before you act, and abide by our Community Guidelines both on and offline. Yes, your offline behaviour can lead to termination of your TPA account.
Below is a list of our community policies. If you violate any of these policies, you might be banned from TPA. To maintain the integrity of the platform, we encourage you to report any behaviour that violates our policies.
Solicitation or Promotion
This platform is for private homeowners only.
Any estate agent found to be contacting a private homeowner for business or commercial purposes will have their profile removed and be banned from the platform. Further, soliciting other users is prohibited on TPA. If the purpose of your profile is to advertise your event or business, non-profit, political campaign, contest, or to conduct research, we may delete your account. Whilst we’re excited that you’re doing an event next week, please don’t use TPA to promote it.
Do not engage, or encourage others to engage, in any targeted abuse or harassment against any other user. This includes sending any unsolicited content to another User. Reports of stalking, threats, bullying, or intimidation, are taken very seriously. In the event that it comes to our attention that someone has harassed, bullied or attacked another user then it is our duty to remove that person’s profile from our platform and also inform all other users who have been in contact with that person on our platform.
For Users to be able to use the platform effectively it is vital that our messaging system is used properly. If you are a potential seller and list your property and a potential buyer messages you directly, then please make sure you reply to that message as quickly as possible and hopefully take no longer than 24 hours. Likewise, if a potential seller messages you back as a potential buyer then please give them the courtesy of a quick reply. The integrity of the platform is soon compromised if users do not reply to each other and it also suggests that the other party may merely be a time waster, which is not good for anyone Time wasters will not be tolerated and may be banned from the platform. Please remember that one day, you may be on the other side looking to speak to a potential seller/buyer so please treat others as you would want to be treated yourself. Our platform intelligently monitors messaging and will contact users who have not replied to other users at various intervals-24hrs, 48 hrs and 72 hrs and then may remove the silent party from the Platform. In the event that your exchange of messaging is completed, then please use the Archive button.
Violence and Physical Harm
We do not tolerate violent, graphic, or gory content on TPA, or any actions or content that advocate for or threaten violence of any sort, including threatening or promoting terrorism. Physical assault, coercion, and any acts of violence are strictly prohibited.
Content that advocates for or glorifies suicide or self-harm is also not allowed. In these situations, we may take a number of steps to assist the user, including reaching out with crisis resources.
Any content that promotes, advocates for, or condones racism, bigotry, hatred, or violence against individuals or groups based on factors like (but not limited to) race, ethnicity, religious affiliation, disability, gender, age, national origin, sexual orientation, or gender identity is not allowed.
Don’t publicly broadcast any private information, yours or anyone else’s. This includes social security numbers, passports, passwords, financial information or unlisted contact information, such as phone numbers, email addresses, home/work address.
Don’t be fake. Be real instead. Don’t use TPA to drive people to external websites via a link or otherwise.
TPA has a zero-tolerance policy on predatory behaviour of any kind. Anyone attempting to get other users’ private information for fraudulent or illegal activity may be banned. Any user caught sharing their own financial account information (PayPal, Venmo, etc.) for the purpose of receiving money from other users may also be banned from TPA.
Be yourself! Don’t pretend to be someone else.
Do not impersonate, or otherwise misrepresent affiliation, connection or association with, any person or entity. This includes parody accounts.
You must be 18 years of age or older to use TPA.
Copyright and Trademark Infringement
If it’s not yours, don’t post it. If your TPA profile includes any work that is copyrighted or trademarked by others, don’t display it, unless you are allowed to do so.
Don’t use TPA to do anything illegal.
One Person, One Account
TPA accounts cannot have multiple owners, so don’t create an account with your friend or significant other. Additionally, please don’t maintain multiple TPA accounts.
TPA is innovative and useful to use! If you don’t log in to your TPA account in 2 years, we may delete your account for inactivity.

What personal data do we collect and how do we use it?
When you contact us or sign up to our services via our website, we may use personal information (such as your name email address, phone number and address/property details/living situation), which you have provided directly, so that our Local Property Angels can understand your property needs better, respond and communicate with you based on Legitimate Interests. Those Legitimate Interests are to enable us to provide an effective commercial service to you and help you with your property buying or selling requirements via our personal property experience call. They also include the recruitment of our Local Property Angels where any data is only collected to screen candidates and judge their suitability to progress to interview.
We may also keep in touch with you about relevant promotions, updates and services based on consent; you can ask us to stop sending you marketing messages by contacting us or unsubscribing to withdraw your consent at any time.
Sharing your information
Following our Local Property Angel personal property experience call, and only with your prior permission, we will share your information with relevant, trusted data processors and vetted UK based partners, such as: solicitors, mortgage brokers, conveyancers, utility companies or property services companies. This will be based on consent.
Where we provide links to websites of other organisations, this privacy notice does not cover how that organisation processes personal information; we encourage you to read the privacy notices on the other websites you visit.
We will retain personal data in line with our retention schedule and will keep your personal data while we have an active engagement and not beyond a period of twelve months. If you request us to remove your details from our database, and providing there is no legal exemption, we will delete your data within seven working days.
If we ever transfer information outside of the European Economic Area (EEA), we will make sure that it is protected and we will ensure the relevant safeguards are in place, for example: we will only transfer it to a non-EEA country with privacy laws that give the same protection as the EEA, as deemed by the European Commission, or transfer it to organisations that are part of Privacy Shield.

As the ‘data subject’ you have certain rights under Data Protection law and in relation to personal data we hold about you and depending on our reason for processing the information. We will require evidence of your identity before we are able to act on your request. Details of these rights and how to exercise them:
• Your right of access: You have the right to ask us for a copy of the personal information about you that we hold, and to confirm the nature of the Information and how it is used
• Your right of rectification: You have the right to ask us to rectify information you think is inaccurate. You also have the right to ask us to complete information you think is incomplete. This right always applies
• Your right of erasure: In certain circumstances, you have the right to request that Information we hold about you is erased
• Your right to object to or restrict processing: In certain circumstances, you have the right to object to our processing of your information by contacting us at the address or email address set our in this notice. For example, if we are processing your information on the basis of our legitimate interests and there are no compelling legitimate grounds for our processing which override your rights and interests. You also have the right to object to use of your information for direct marketing purposes.
• Your right of data portability: This only applies to information you have given us. You have the right to ask that we transfer the information you gave us from one organisation to another, or give it to you. The right only applies if we are processing information based on your consent or under, or in talks about entering into a contract and the processing is automated.
